WAIVER

EAST COAST SURF DEVELOPMENT LLC WAIVER, LIABILITY AND INDEMNITY AGREEMENT ACKNOWLEDGMENT OF RISKS

This form must be signed prior to attending ECSD classes, events, courses or camps. If the participant is a minor, this waiver must be signed by a parent.

In consideration of the risk of injury while participating in any ECSD Surf Class, event, contest, camp or course and as consideration for the right to participate in the program, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability. I hereby waive any and all rights, claims, or causes of actions of any kind whatsoever arising out of my participation in any programs with ECSD. I hereby release and forever discharge East Coast Surf Development LLC, its affiliates, instructors, coaches, owners, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns for any physical or psychological injury, including but not limited to illness, paralysis, pain, suffering, disfigurement, temporary or permanent disability, death, damages, or economic or emotional loss that I may suffer as a direct result of my participation in the surfing program, including traveling to and from the activity.

I am voluntarily participating myself and/or my child in the ECSD program, entirely at my own risk, understanding that injuries may arise from my own or others’ actions. Nonetheless, I assume all related risks associated with my participation in this program. I further agree to indemnify and hold harmless East Coast Surf Development LLC and others listed for any and all claims arising as a result of my participation in the program, whenever, wherever, and however activities may occur.

I hereby agree that ECSD may use images of any surfing for its promotional and/or commercial purposes, and I consent to the use of my name and likeness for such use in any media now known or not known without compensation to me.

I ACKNOWLEDGE THAT I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY

FOR PARTICIPANTS UNDER 18 YEARS OLD, I hereby certify that I am the parent or guardian with legal responsibility for this participant, and that I have read and understood the above and I consent and agree to his/her release as provided above. In consideration of the minor participant’s participation in the ECSD surf class, event, lesson or camp, for myself, my heirs, assigns, personal representatives, and next of kin, I hereby release and agree to indemnify and hold harmless East Coast Surf Development, its instructors, officers, employees, agents and contractors from any and all liabilities incident to minor’s involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.
